Terms of Service

1. Parties

These Terms of Service ("Terms") constitute a legal agreement between you ("Client") and ENGINERIT CONSULTORIA TECNOLOGICA S.L. (CIF B25958703), operating under the brand "Hostbrid" ("Provider"), with registered address at Calle Aneto 2, P.2 Pta.1, 08227 Terrassa, Barcelona, Spain.

2. Services

Hostbrid provides the following cloud infrastructure services:

• Shared web hosting (websites, email, databases, FTP, DNS)
• Virtual Private Servers (VPS) with full root access
• SSL certificate management (via Let's Encrypt)
• Email hosting (IMAP/SMTP with DKIM, SPF, DMARC)
• DNS management and domain configuration
• Automated backups and restoration

3. Payment and Billing

• All prices are displayed in EUR and include VAT (IVA) where applicable.
• Payment is processed securely via Stripe. We accept Visa, Mastercard, American Express, and other major cards.
• Subscriptions are billed monthly or annually, as selected during checkout.
• Annual subscriptions receive a 20% discount compared to monthly billing.
• Services are activated immediately upon successful payment.

4. Service Level Agreement (SLA)

If monthly uptime falls below 99.9%, the Client is entitled to a service credit:

• 99.0% - 99.9%: 10% credit of monthly fee
• 95.0% - 99.0%: 25% credit of monthly fee
• Below 95.0%: 50% credit of monthly fee

5. Cancellation and Refunds

• 30-day money-back guarantee: New clients may request a full refund within 30 days of their first payment, no questions asked.
• Cancellation: You may cancel your subscription at any time from your dashboard. Services remain active until the end of the current billing period.
• Data after cancellation: Upon cancellation, your data will be retained for 30 days to allow recovery. After this period, all data is permanently deleted.

6. Acceptable Use Policy

You agree not to use Hostbrid services for:

• Any activity that violates applicable laws or regulations
• Sending unsolicited commercial email (spam)
• Hosting malware, phishing sites, or content that infringes intellectual property rights
• Cryptocurrency mining on shared hosting plans
• Activities that consume excessive resources affecting other users (shared hosting only)
• DDoS attacks, port scanning, or unauthorized access attempts

Violation of this policy may result in immediate suspension of services without refund.

7. Backups

Hostbrid performs automated backups according to each plan's specifications (weekly or daily). While we make every effort to ensure backup integrity, the Client is ultimately responsible for maintaining their own copies of critical data. Hostbrid is not liable for data loss beyond restoring from available backups.

8. Limitation of Liability

To the maximum extent permitted by law, ENGINERIT CONSULTORIA TECNOLOGICA S.L.'s total liability for any claim arising from these Terms shall not exceed the total amount paid by the Client in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business interruption.

9. Privacy and Data Protection

The processing of personal data is governed by our Privacy Policy, in compliance with the GDPR and LOPDGDD. By using our services, you acknowledge that you have read and understood our data processing practices.

10. Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified via email at least 30 days before taking effect. Continued use of the services after the effective date constitutes acceptance of the modified Terms.

11. Applicable Law and Jurisdiction

These Terms are governed by Spanish law. Disputes shall be resolved by the courts of Barcelona, Spain, without prejudice to any mandatory consumer protection jurisdiction that may apply.
